1. Introduction and Acceptance

Welcome to PermitMapper ("we", "our", "us", or the "Service"). PermitMapper is operated in New Zealand and provides a web-based tool for processing heavy vehicle permit documents and displaying bridge locations on interactive maps.

By accessing or using PermitMapper, you ("User", "you") agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service.

These Terms are governed by and construed in accordance with the laws of New Zealand, including the Contract and Commercial Law Act 2017, Consumer Guarantees Act 1993, and Fair Trading Act 1986.

2. Description of Service

PermitMapper provides the following services:

• Processing of heavy vehicle permit documents (PDF, DOC, DOCX, TXT, RTF formats)
• Extraction of bridge coordinates from permit documents
• Display of extracted locations on interactive maps
• Route planning functionality between locations
• Sharing of maps via unique links
• User account management and permit history (for registered users)

The Service is provided as a tool to assist with permit interpretation and does not replace professional advice or official permit documentation.

3. User Accounts

3.1 Registration

To access certain features, you may register for an account. You must provide accurate and complete information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorised use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods. You may delete your account at any time by contacting us.

4. Acceptable Use

When using PermitMapper, you agree NOT to:

• Upload malicious files, viruses, or harmful content
• Attempt to gain unauthorised access to our systems
• Use the Service for any unlawful purpose
• Upload documents you do not have the right to process
• Share access credentials with unauthorised parties
• Attempt to reverse engineer or interfere with the Service
• Use automated tools to scrape or access the Service excessively
• Misrepresent your identity or affiliation

5. Intellectual Property

5.1 Our Content

The PermitMapper platform, including its design, functionality, and underlying code, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform without permission.

5.2 Your Content

You retain ownership of the permit documents you upload. By uploading documents, you grant us a limited licence to process and store them solely for the purpose of providing the Service to you.

5.3 Map Data

Map tiles and geographic data are provided by OpenStreetMap contributors under the Open Database License (ODbL). Routing services are provided by third-party services subject to their own terms.

6. Disclaimers and Limitations

6.1 No Professional Advice

IMPORTANT: PermitMapper is a document processing tool only. The information displayed:

• Is NOT a substitute for reading and understanding your official permit documents
• Should NOT be relied upon as the sole source of information for route planning
• May contain errors due to document formatting, OCR inaccuracies, or coordinate conversion
• Does NOT constitute legal, transport, or professional advice

Always refer to your original permit documents and consult with relevant authorities for definitive information.

6.2 Accuracy of Information

While we strive to accurately extract and display information from permit documents, we make no guarantees regarding:

• The accuracy of extracted coordinates or bridge locations
• The completeness of extracted speed limits or restrictions
• The accuracy of routes calculated by third-party routing services
• Real-time road conditions, closures, or changes

6.3 Service Availability

The Service is provided "as is" and "as available". We do not guarantee uninterrupted access and may modify or discontinue features at any time.

6.4 Limitation of Liability

To the maximum extent permitted by New Zealand law, including the Consumer Guarantees Act 1993 where applicable:

• We are not liable for any indirect, incidental, special, or consequential damages
• We are not liable for losses arising from reliance on information displayed by the Service
• We are not liable for damages resulting from fines, penalties, or accidents related to permit compliance
• Our total liability for any claim shall not exceed NZD $100

Nothing in these Terms excludes or limits liability that cannot be excluded under New Zealand law, including liability for death or personal injury caused by negligence.

7. Indemnification

You agree to indemnify and hold harmless PermitMapper and its operators from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

8. Privacy

Your use of PermitMapper is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with the New Zealand Privacy Act 2020.

9. Third-Party Services

PermitMapper uses the following third-party services:

• OpenStreetMap: Map tiles and geographic data
• OSRM (Open Source Routing Machine): Route calculation
• Nominatim: Address geocoding

These services are subject to their own terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.

10. Modifications to Terms

We may update these Terms from time to time. Material changes will be notified via the Service or by email to registered users. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law and Disputes

These Terms are governed by New Zealand law. Any disputes shall be resolved in the courts of New Zealand. Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation.

12. General Provisions

• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and PermitMapper.
• Assignment: You may not assign your rights under these Terms without our consent.
